Insurance Layers in a Rideshare Accident
Both Uber and Lyft provide commercial liability insurance for accidents involving their drivers while the app is active. Coverage amounts vary by phase:
- App off: Only the driver's personal auto insurance applies
- App on, no passenger: Rideshare company provides contingent liability coverage (typically $50,000 per person/$100,000 per accident/$25,000 property damage)
- Passenger in vehicle or en route to pickup: Rideshare company's full commercial policy ($1 million liability coverage) applies
No-Fault Coverage in Rideshare Accidents
If you were a passenger in an Uber or Lyft that was in an accident, you are covered by the vehicle's No-Fault insurance — which in the case of a commercial rideshare vehicle may be the rideshare company's commercial policy. The same 30-day filing deadline applies.
