The Basics: What No-Fault Is
New York is a No-Fault auto insurance state. This means that after a car accident, your own auto insurance policy — through its Personal Injury Protection (PIP) component — pays for your medical treatment up to a mandatory minimum of $50,000. You do not need to prove fault, file a lawsuit, or pay out of pocket to access these benefits.
Who Is Covered
No-Fault covers the policyholder and all passengers in the vehicle at the time of the accident. Pedestrians struck by an insured vehicle can claim No-Fault benefits through the vehicle's insurance policy. Motorcyclists are not covered by No-Fault for their own motorcycle insurance, but may be able to claim through the at-fault driver's policy if struck by an insured vehicle.

- All necessary medical treatment related to accident injuries
- Lost wages — up to $2,000 per month for up to 3 years
- Transportation costs to medical appointments
- Other reasonable out-of-pocket expenses related to the accident
The 30-Day Deadline
