New York is a No-Fault state. If you were injured in a motor vehicle accident, your own auto insurance pays for your medical care — up to $50,000 — regardless of who caused the accident. You do not need an attorney or a fault determination to begin treatment.

If your injuries prevent you from working, No-Fault replaces up to 80% of your gross monthly income — up to $2,000 per month — for as long as you are disabled, for up to 3 years.

If the accident results in a fatality, No-Fault provides a $2,000 lump sum death benefit to the surviving spouse or dependents, in addition to all medical costs incurred before death.
You must file your No-Fault application (NF-2 form) within 30 days of the accident. Missing this deadline can result in full claim denial — even if your injuries are real and serious.
