Pedestrian Rights Under New York No-Fault
If you were struck by a motor vehicle as a pedestrian in New York, you have the right to No-Fault medical benefits through the auto insurance policy of the vehicle that struck you — up to $50,000 in medical coverage, regardless of fault. If the vehicle was uninsured, you may be able to claim through the Motor Vehicle Accident Indemnification Corporation (MVAIC).
This No-Fault coverage is in addition to any personal injury lawsuit you may file against the driver. You can receive No-Fault medical benefits AND pursue a PI claim simultaneously.
