What Happened

On the evening of May 15, 2026, a devastating crash unfolded on Manhattan's Upper West Side. According to the NYPD, a 61-year-old driver traveling northbound on Amsterdam Avenue near West 109th Street lost control of his Mercedes sedan around 6 p.m.

The vehicle struck several parked cars — including a Volkswagen and a minivan — before hopping the curb and slamming into a group of five men who were standing and sitting outside a barbershop at 996 Amsterdam Avenue.

Two men, ages 35 and 46, were pronounced dead. Three others, between the ages of 36 and 52, were rushed to St. Luke's Hospital in critical condition. Cellphone video from the scene showed bystanders struggling to lift the vehicle off a man pinned underneath.

The driver, identified as Elvin Suarez, was taken into custody and charged with DWI and manslaughter. Sources say he appeared intoxicated at the scene.

Why This Matters

DWI crashes that injure pedestrians typically generate complex personal injury cases involving multiple parties — the intoxicated driver, the driver's insurance carrier, and potentially additional parties depending on where the driver was coming from (dram shop liability if served alcohol at a bar).

For the three survivors hospitalized in critical condition, immediate and thorough medical documentation is essential. Injuries sustained in pedestrian crashes — traumatic brain injury, spinal cord damage, orthopedic fractures — require specialist evaluation from day one. The quality of early medical records directly impacts any future personal injury claim.

Pedestrian Rights After a NYC Crash

Under New York's No-Fault law (Insurance Law § 5101 et seq.), pedestrians struck by a vehicle are entitled to Personal Injury Protection (PIP) benefits regardless of who was at fault. These benefits cover:

  • Medical expenses up to $50,000
  • Lost wages (80% of gross wages, up to $2,000/month)
  • Other reasonable and necessary expenses

Pedestrians file their No-Fault claim with the insurance carrier of the vehicle that struck them. The critical deadline: you must provide written notice to the insurer within 30 days of the accident (Regulation 68).

Beyond No-Fault, victims of DWI crashes can also pursue a third-party personal injury lawsuit against the intoxicated driver for damages exceeding the PIP limits — including pain and suffering, which No-Fault does not cover.

⚖️ Know Your Rights

  • You may also have a third-party lawsuit for pain, suffering, and damages beyond PIP limits
  • Consult a personal injury attorney to understand your full rights
