The 3 Phases of Rideshare Insurance in NYC
Under New York Vehicle and Traffic Law Article 44-B (Section 1692 et seq.), companies like Uber and Lyft are classified as Transportation Network Companies (TNCs). Their insurance coverage is divided into three distinct phases based on what the driver was doing at the moment of impact:
Phase 1: App Off — Driver's Personal Insurance Only
If the driver was not logged into the rideshare app, neither Uber nor Lyft's insurance applies. Only the driver's personal auto insurance is in play — which may have limited coverage.
Phase 2: App On, No Ride Accepted
The driver is logged in and available but hasn't accepted a trip. NY TNC law requires minimum coverage of:
- $75,000 per person / $150,000 per accident in bodily injury liability
- $25,000 for property damage
- No-Fault PIP also applies
Phase 3: Active Ride — Full Commercial Coverage
Once a ride is accepted and while a passenger is in the vehicle, the full commercial policy activates:
- Up to $1.25 million for bodily injury, death, and property damage
- Mandatory UM/UIM coverage (uninsured/underinsured motorist)
- No-Fault PIP up to $200,000 in NYC (far more than the standard $50K for private vehicles)
